The collaborative resolution process for separating families

The collaborative resolution process to financial settlement provides an alternate approach to the standard legal approach. It leverages the capabilities of financial advisers, accountants and lawyers, increasing the likelihood of creating a holistic solution that will work for everyone.  Particularly where separating couples have a relationship that remains amicable, the collaborative approach is a cost-effective method of settlement that has longevity and sets both parties up for a fresh start.

Collaborative resolution allows for the identification of both short term and long term goals of both parties and a shared understanding of what is important to each party going forward in their new lives.  By identifying the key goals and interests of the separating parties, a solution can be derived that aligns with the values and beliefs of the family.

In contrast, the traditional legal approach often only considers legal issues, delivering a limited solution which often results in frustration for all parties.  In addition to being adversarial, it can be expensive and a drawn-out emotional and financial burden on both parties.

OUR COLLABORATIVE APPROACH TO FINANCIAL SEPARATION

LISTEN

We seek to understand how you arrived here and the concerns of you and your former partner. And we identify what is important for you, your former partner and your family going forward.

RESEARCH

We then gather information to understand where you are at financially.  We document what you own, what you owe, what you earn and what you spend to build a complete financial picture.

EDUCATE

While we are gathering this information, we also take the time to educate you on the factors that come into play. And you’ll be prompted to think about options that may work for both parties.

WORKSHOP SOLUTIONS

Once we have this information, we evaluate the possible uncoupling options from an emotional and financial perspective and then agree on an option that most closely aligns with the most important goals of both of you. We always strive for ‘win-win’ rather than ‘win-lose’ solution.

LEGAL DOCUMENTATION

It is only at this point, once we’ve agreed on solution what is agreeable to both of you, we get lawyers directly involved. One to draft the written legal agreement that accurately reflects your settlement terms and another to represent your former partner in reviewing the document.

IMPLEMENTATION

Upon agreement, we work with you to implement the terms of the settlement.  We aim to complete the implementation as quickly and as smoothly a possible, so you can focus on your future and building your new uncoupled life.
